These Terms of Service (“Terms”) govern your access to and use of the Peak platform, including the website at trypeak.io and all related services (collectively, the “Service”), operated by Voxwave AI Pvt Ltd (“Peak”, “we”, “our”, or “us”).
By creating an account or using Peak in any way, you agree to be bound by these Terms. If you are using Peak on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, do not use the Service.
1. About Peak
Peak is an AI employees platform that allows users to create and manage autonomous AI employees within a structured organizational framework. Users can assign roles to AI employees, connect third-party business tools, delegate tasks, and receive completed work for review and approval.
2. Eligibility
To use Peak, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable laws in your jurisdiction
- If using Peak on behalf of an organization, have the authority to bind that organization to these Terms
By using Peak, you confirm that you meet all of these requirements.
3. Your Account
3.1 Account Creation
To access Peak, you must create an account by providing accurate, current, and complete information. You are responsible for keeping your account information up to date.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You must not share your password with anyone. You are responsible for all activity that occurs under your account, whether or not authorized by you.
If you suspect unauthorized access to your account, you must notify us immediately at support@trypeak.io.
3.3 One Account Per User
Each individual may maintain only one personal Peak account. You may not create multiple accounts for the same individual.
3.4 Account Suspension and Termination
We reserve the right to suspend or terminate your account at any time if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent or illegal activity, or if your account has been inactive for an extended period. We will make reasonable efforts to notify you before taking such action.
4. The Peak Platform
4.1 AI Employees
Peak enables you to create AI employees within a structured organizational hierarchy. These AI employees are software agents powered by artificial intelligence. They are not real employees, contractors, or agents of Peak. You are solely responsible for the goals, tasks, and instructions you provide to your AI employees and for reviewing and approving their output.
4.2 Your Role as the Board
When you use Peak, you operate as the board of your AI company. This means:
- You retain ultimate authority over all decisions made within your Peak workspace
- You are responsible for approving significant actions before they are executed by your AI employees
- You are responsible for setting budgets and monitoring credit usage
- You are responsible for the quality, accuracy, and appropriateness of all work produced by your AI employees
Peak provides the platform and infrastructure. You direct and oversee how it is used.
4.3 Connected Tools and Integrations
Peak allows you to connect third-party tools and services to your workspace. By connecting a third-party tool, you:
- Authorize Peak and your AI employees to access and interact with that tool on your behalf
- Confirm that you have the right and authorization to grant that access
- Accept that your use of those tools is also governed by the terms and privacy policies of those third-party services
- Acknowledge that Peak is not responsible for the availability, reliability, or actions of any third-party service
You can revoke access to connected tools at any time from your account settings.
4.4 Approvals and Review
Peak includes approval workflows that require your sign-off before certain actions are taken by your AI employees. You are responsible for reviewing approval requests carefully and promptly. Peak is not responsible for any outcomes resulting from actions you approve.
5. Acceptable Use
5.1 Permitted Use
You may use Peak only for lawful business purposes in accordance with these Terms and all applicable laws and regulations.
5.2 Prohibited Use
You agree not to use Peak to:
- Violate any applicable law, regulation, or third-party right
- Engage in any fraudulent, deceptive, or misleading activity
- Harass, threaten, or harm any individual or group
- Generate, distribute, or publish content that is defamatory, obscene, hateful, or discriminatory
- Infringe the intellectual property rights of any third party
- Attempt to reverse engineer, decompile, or extract the source code of the Peak platform
- Circumvent or attempt to bypass any security measures, access controls, or rate limits
- Use the Service to develop a competing product or service
- Scrape, crawl, or extract data from Peak using automated means without our prior written consent
- Use the Service to send spam, unsolicited communications, or run automated outreach campaigns without appropriate consent from recipients
- Introduce malware, viruses, or any harmful code into the platform
- Use the Service to process or store sensitive personal data such as government identification numbers, medical records, financial account credentials, or any data that requires special regulatory handling unless you have obtained all necessary consents and comply with all applicable regulations
5.3 Responsibility for Content
You are solely responsible for all content, data, instructions, and tasks you input into Peak and for all output produced by your AI employees on your behalf. Peak does not review, moderate, or take responsibility for user-generated content within the platform.
6. Credits and Billing
6.1 Credits
Peak operates on a credit-based system for AI employee activity. Credits are consumed each time an AI employee performs work. The credit cost of each action is displayed within the platform.
6.2 Budget Controls
You can set monthly credit budgets for each AI employee. When an employee reaches their budget limit, they pause automatically. You are responsible for monitoring budgets and topping up credits as needed.
6.3 Subscriptions
Peak also offers subscription plans that include a monthly credit allocation. Subscription fees are billed in advance on a monthly basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
6.4 Pricing
Current pricing is available on the Peak pricing page. We reserve the right to change our pricing at any time. We will provide at least 30 days notice before any price changes take effect for existing subscribers.
6.5 Refunds
Credits purchased are non-refundable except where required by applicable law. If you cancel a subscription, you will retain access to the Service until the end of the current billing period. We do not provide partial refunds for unused subscription periods.
6.6 Taxes
Prices listed on Peak are exclusive of applicable taxes. You are responsible for paying any applicable taxes, including GST in India, that are due on your purchases.
6.7 Failed Payments
If a payment fails, we will notify you and attempt to process the payment again. If payment cannot be collected after reasonable attempts, your account may be downgraded or suspended until payment is resolved.
7. Intellectual Property
7.1 Peak’s Intellectual Property
The Peak platform, including its design, code, AI models, features, and all related content created by Peak, is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the platform.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own business purposes, subject to these Terms.
7.2 Your Content and Data
You retain ownership of all content, data, and intellectual property you bring to Peak, including data from connected tools and any output produced by your AI employees acting on your instructions.
By using Peak, you grant us a limited license to access, store, and process your content solely to the extent necessary to provide the Service. We will not use your content for any other purpose.
7.3 Feedback
If you submit feedback, suggestions, or ideas about Peak, you grant us the right to use that feedback without restriction and without any obligation to compensate you.
8. Confidentiality
You may have access to non-public information about Peak, including product roadmaps, pricing strategies, or technical details shared during onboarding or support. You agree to keep such information confidential and not to disclose it to any third party without our prior written consent.
9. Privacy
Your use of Peak is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read the Privacy Policy carefully to understand how we collect, use, and protect your information.
10. Third-Party Services
Peak integrates with various third-party tools and services. We are not responsible for the availability, accuracy, or actions of any third-party service. Your use of any third-party service connected to Peak is governed by that service’s own terms and privacy policies.
11. Disclaimers
11.1 Service Provided As Is
The Service is provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
11.2 No Guarantee of Results
Peak provides tools and infrastructure for deploying AI employees, but we make no guarantees about the quality, accuracy, or outcomes of any work performed by your AI employees. You are responsible for reviewing all output before using it.
11.3 AI Limitations
AI technology is not perfect. Your AI employees may make mistakes, misunderstand instructions, or produce incorrect output. You are responsible for implementing appropriate review and approval workflows to catch errors before they cause harm.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Peak and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business, or reputational harm, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to Peak in the 12 months preceding the claim, or (b) one hundred Indian Rupees (INR 100).
Nothing in these Terms limits our liability for fraud, gross negligence, or willful misconduct.
13. Indemnification
You agree to indemnify, defend, and hold harmless Peak and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any content or instructions you provide to the platform
- Any actions taken by your AI employees on your behalf
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of India, without regard to its conflict of law principles.
Any dispute arising out of or in connection with these Terms or your use of the Service shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in Chennai, Tamil Nadu, India, in accordance with the Arbitration and Conciliation Act, 1996.
You agree that any dispute resolution proceedings shall be conducted on an individual basis and not as a class action or collective proceeding.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice within the platform at least 14 days before the changes take effect.
Your continued use of Peak after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Peak regarding your use of the Service.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
16.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights under these Terms without restriction.
16.5 Force Majeure
Peak shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, acts of government, power outages, internet disruptions, or other force majeure events.
